Intellectual Property Notice 

1. Rights to artwork remain the sole property of SANTHANHA NGUYEN LTD including after purchase. This includes the purchase of originals, commissions, prints and current and/or future reproductions of any kind.

 

2. The purchase of any item, original or otherwise, does not grant the customer permission to mint the piece into an NFT, print and distribute in any form or reproduce in any way by means of profit and/or otherwise.

 

3. Collectors may not reproduce artwork in any way without express written permission from the artist. Posting images of the items purchased on social media are always welcome and does not breach this clause.

Product Safety & Compliance

We are committed to ensuring that all products offered on this website comply with the EU’s General Product Safety Regulation (GPSR), effective from December 13, 2024. This commitment ensures that our products meet the highest safety standards for our customers in the European Union and Northern Ireland.

1. Product Safety and Compliance

  • Product Identification: Each product is clearly labeled with a unique identifier, including type, batch, or serial number, to ensure traceability.

  • Manufacturer Information: As the creators of these art prints, we provide our name, registered trade name or trademark, and contact details, including our postal and electronic addresses.

  • EU Responsible Person: For customers within the EU and Northern Ireland, we have appointed an Authorized Representative to act on our behalf regarding product safety compliance:

2. Two-Year Warranty:

In compliance with EU regulations, all our products come with a mandatory two-year warranty. This warranty covers any defects in materials or workmanship under normal use during the warranty period. Should you encounter any issues with our products, please contact our representative at  info@theprintspace.co.uk , and they will be happy to assist you with repairs, replacements, or refunds as necessary.

3. Risk Assessments and Technical Documentation:

We conduct thorough risk assessments for all our products to identify and mitigate potential hazards. Comprehensive technical documentation is maintained and can be provided upon request to demonstrate compliance with safety requirements.

4. Incident Reporting and Product Recalls:

We monitor customer feedback diligently. In the unlikely event of a safety concern, we are prepared to take immediate corrective actions, including notifying customers and relevant authorities, and conducting product recalls if necessary.

Liability

1. Customer Responsibility After Receipt:
Once products are in the possession of the customer or collector, we cannot be held liable for damage caused by mishandling, misuse, or failure to follow care instructions. Examples include (but are not limited to) smudging fingerprints on borders, tearing fine art prints, or accidental damage after delivery.

 

2. Damage During Delivery / Faulty Goods:
In line with EU consumer protections and our two-year warranty, customers are entitled to compensation if goods arrive damaged due to postal services, or if faulty merchandise is dispatched. All products undergo thorough quality control before shipment, and only pristine items are packaged.

3. Product Information:
We provide clear product descriptions, including accurate dimensions and details about borders. It is the customer’s responsibility to review this information before purchase. We are not obliged to compensate for dissatisfaction arising from failure to read product descriptions.

 

4: Statutory Rights:
Nothing in this section limits or excludes your statutory rights under applicable consumer protection laws, including the EU’s General Product Safety Regulation (GPSR) and the mandatory two-year warranty period.

Duties and taxes

The studio is based in the United Kingdom and is not liable for import fees on any products purchased. This applies to all items, including commissioned works, originals, and fine art merchandise.

Any applicable taxes, duties, or VAT are not included in the checkout total. These charges are determined by the customs agency in the destination country. Some countries may not charge any fees, while others may. If required, the customs agency will contact the recipient by mail, phone, or email with instructions to pay these charges before the shipment can be delivered.

It is the responsibility of the customer to pay any import duties, VAT, or related fees. If these charges are refused, the shipment will be returned to us. Once returned, and provided the product is in its original condition, we will issue a refund for the cost of your order, minus the original shipping costs.

Please note: Items are declared at purchase value for exporting and under no circumstance will documents be falsified at your request.

Returns, Replacements and Refunds

1. No Returns for Change of Mind:
All our prints are made to order and are non-restockable items. Thus, we do not accept returns or offer refunds simply because you have changed your mind or no longer want the product.

2. Eligibility for Refunds or Replacements:
Notwithstanding the above, we offer refunds or replacements only in the following exceptional cases:

  • The item arrives damaged or defective.

  • There is a significant delivery delay (at our discretion). Note: normal postal delays or delays due to customs are not eligible.

3. How to Request a Refund or Replacement:

Prompt Notification: You must notify us immediately upon receipt (or as soon as you become aware) if the print is damaged or defective, or if you believe a delivery delay is significant.

  • Evidence: You must provide clear photographic evidence of the damage, defect, or proof of delay.

  • Return Request: We may request the return of the print (at our cost) for inspection or disposal at our discretion.

  • Decision & Remedy: After inspection, we will decide whether to issue a replacement, refund, or other remedy.

4. Non-Returnable Items:

  • Original Artworks: These are not returnable.

  • Prints: Prints are not eligible for return unless damaged or defective.

5. Refund Processing:

  • Timeline: Once we receive and inspect any returned item, eligible refunds will be processed within 10 business days.

  • Method: Refund will be issued to the original payment method.

  • Bank / Payment Processor Delays: Please note that your bank or payment provider may take additional time to credit your account.

6. Exchanges / Reorders:
We do not offer direct “exchanges.” If you want a different print, please return the original (if eligible) and place a new order for the desired print.

Purchases, Shipping & Payment policy

1. Processing & Dispatch:

Processing times for each item are stated in the product descriptions. On occasion, dispatch may be delayed (for example, if an artwork is experiencing a sudden surge in orders). We thank you for your patience.

 

Orders are fulfilled through ThePrintSpace’s print-on-demand service. Their typical production times are usually dispatched within 48 hours. However, this is only a guideline, and not guaranteed.

2. Shipping & Address Changes:

If you need to change your shipping address, you must notify us within 24 hours of placing your order. Once production or dispatch has started, we cannot make changes. It is your responsibility to provide a complete and accurate delivery address, including apartment/unit numbers and postal codes.

 

Santhanha Nguyen Ltd is not responsible for undelivered packages resulting from customer error in the shipping address. If an order is returned due to an incorrect or incomplete address, reshipment costs may apply.

3. Payment & Pricing:

Payment is taken at checkout before your order enters production. Prices shown at the time of purchase include printing and delivery. We may update prices at any time, but this will not affect confirmed orders.

 

Accepted payment methods include major debit/credit cards and PayPal (depending on your checkout system). Once ThePrintSpace has begun production, orders cannot usually be cancelled.

4. Risk & Ownership:

Responsibility for the goods passes to you once they are delivered to the shipping address provided. Ownership of the goods passes to you when full payment is received.

5. Original Artwork Purchases:

If you wish to purchase an original artwork, please add the item to your cart and include a note with your name, address, and email. We will then contact you directly to confirm the price and shipping costs, which vary depending on your location and destination country.

 

Please note: The price displayed as “£0” is not the actual cost of the piece. You are not committed to purchase until all relevant details (final price, shipping costs, and delivery information) have been confirmed with you via email.

 

⚠️ Do not complete checkout for original artworks. If you proceed, the system may automatically charge shipping fees that cannot be refunded.
